SHC enforces Karachi’s master plan for development

On a petition filed by the Sindh High Court (SHC) stating that the notified Karachi Strategic Development Plan 2020 was still in its infancy stage and that the laws governing town planning needed to be harmonised, the Sindh High Court (SHC) issued notices to the secretary of local governments, Karachi Development Authority and others.

M. Tariq Mansoor, the petitioner, argued that stemming from the Supreme Court’s instructions in February 2020, a separate master plan authority was created — the Sindh Master Plan Authority. In spite of the fact that several years have passed, the provincial government has yet to pass the statutory act, and it has yet to draft rules for its implementation, he said.

In addition, he has argued that, despite the fact that the Karachi Strategic Development Plan under the law should have been implemented effectively and sustainably, it has not been implemented effectively and sustainably, thus leading to deteriorating governance and anarchy in the city.

Specifically, the counsel claimed that as stated in Clause 1.8 of the subject strategic development plan, within the scope of the Pakistan 2030 vision, the operational timeframe for the plan extends to 2020. In terms of the period assigned, it was based primarily on the feasibility of achieving the plan goals and making the resources available within the foreseeable future in order to ensure that the objectives of the plan were achieved.

A petitioner has claimed that, as per the clause 1.8 of the instant plan, the coverage of the city region will extend to 2030, under the minister of transport and communications’ 2030 vision, which covers parts of the surrounding districts of Thatta, Jamshoro and Lasbela and also includes Parts of the surrounding districts of Jamshoro and Thatta.

Due to poor governance, functional chaos in the city, and a general lack of respect for the citizen’s right to a safe and secure living environment, despite the announcement of the master plan for Karachi, the plan has yet to go into effect.

It has been requested that the Sindh government be ordered by the high court to enforce in letter and spirit the Karachi Strategic Development Plan 2020 that was notified in December of this year and to harmonise it with the existing laws and regulations of Karachi, Malir, Lyari Development Authority and cantonment boards as well. After a preliminary hearing of the petition was conducted in the high court division bench of Justice Salahuddin Panhwar, he issued notices to the secretary of local governments, to the KDA, and others requesting their comments on the next date of the hearing of the petition.
