Imran Khan writes to CJP Isa seeking equal participation for PTI. Is Imran Khan, the chairman of Pakistan Tehreek-e-Insaf (PTI), calling on Chief Justice of Pakistan (CJP) Qazi Faez Isa, to ensure that Pakistan Tehreek-e-Insaf (PTI) enjoys a level playing field leading up to the much-awaited general elections of 2024, scheduled for February 8 next year, has issued a directive to the CJP to ensure a level playing field for his party.
Former prime minister, who remains imprisoned in Adiala jail, has raised several concerns regarding the “discrimination” the former ruling party is experiencing as a result of being denied equal opportunities in leading the party’s political campaign in a letter seeking equal opportunities.
During the course of his speech, Khan urged the top judge to take advantage of his constitutional authority to make sure that the federal, provincial and election commissions of Pakistan (ECP) are given the authority they deserve to ensure that PTI, as well as all other political parties, is permitted to hold political meetings and gatherings without discrimination.
A no-trust motion was filed against the deposed prime minister in April of last year, and as a consequence of that motion, he was removed from power. In his letter, the PM alleged to have targeted the PTI leaders and activists by registering several criminal cases against them in a bid to keep them behind bars. His words describe this as a “tactic of abuse and oppression” that, according to him, is being used all over the country to coerce and entrap people.
It is common for those who have been bailed out of court in one or more cases to be immediately booked in further cases that purport to pertain to events that take place several months after the bailout. It is not uncommon for several FIRs to be filed against people in the PTI who were associated with the same event. There have also been multiple incidents where the same individuals have been implicated in successive FIRs for different and unrelated reasons throughout the country,” the letter continues.
It has been reported that several women arrested after the events of May 9 remain imprisoned nearly six months after they were arrested in the aftermath of those events, according to the former premier who is held in Adiala jail on charges of cipher and corruption.
As a result of the letter, the CJP was drawn to the petitions filed by the PTI against such arrests and the registration of cases in “undisclosed” FIRs which had been filed by the PTI at the provincial high courts. However, because of the unfavourable observations of a bench of the Supreme Court, the high courts are unable to protect the rights of PTI leaders and activists.
It is important to note, however, that a bench of the apex court has made unfavourable observations about the salutary safeguards provided by the respective high courts, which has prevented the high courts from taking action to safeguard the rights to liberty and due process available to all the people of Pakistan, including those who support the PTI. As a result of the observations of the apex court, there has been a fresh wave of state operations spreading through the Punjab, Khyber Pakhtunkhwa and Islamabad capital territories.”
I believe this is a situation that needs to be brought to the attention of the high court and taken into consideration as soon as possible.
It was also mentioned in the letter that the PTI, its previous government, and some of the individuals affiliated with the party disappeared, and that later on, at some point in time, they disassociated with the party.
There was no proof that these individuals were tutored by anyone until they re-appeared and made press conferences.
The PTI chief has stated that the fairness of the general elections is impossible without the intervention of the Supreme Court to stop the widespread arrests and abductions that have been taking place.
In his opinion, there is a widespread disgust among people, including those who support the PTI, due to the actions “favoring one set of political actors” and against them.
As a result of the foregoing and in order to prevent any kind of violation of fundamental rights and to grant justice to the people of Pakistan, it is respectfully prayed that the apex court of the country may kindly exercise the power available to it in order to ensure the enforcement of fundamental rights by making, inter alia, the following orders.
Thereafter, the court was requested to put an end to the arrests and registration of FIRs against the bailed-out individuals and to stop arresting and registering such cases against them.
In addition to this, the petition also requested that the court create a commission to investigate the disappearances and abductions of journalists and political workers, as well as instruct the Pakistani government and Pakistan Electronic Media Regulatory Authority (Pemra) to ensure that all parties and their leaders have equal access to media coverage.
